- Immigration Pilots
Two of Canada’s amazing immigration pilots are LMIA-exempt. The four maritime provinces manage The Atlantic Immigration Pilot: Nova Scotia, New Brunswick, Prince Edward Island, and Newfoundland and Labrador. By obtaining a job offer from one of the participating employers in the provinces without needing an LMIA document, you can immigrate to Canada and settle in one of these beautiful seaside provinces through the Pilot.
The Home Child Care Provider Pilot or the Home Support Worker Pilot can be used to apply to immigrate to Canada by the foreign national caregivers. Caregivers would be issued open work permits instead of employer-specific work permits when they submit their applications for permanent residency. Thus they are allowed the freedom to work for any employer in Canada to fulfill their work hour requirements for permanent residency.
- Specific Visa Holders
It is possible to work in Canada without an LMIA document for the spouses and common-law partners of certain visa holders or immigration applicants. For example without the need of an LMIA, the significant other of an international student with a valid study permit can find a job in Canada. On top of that, the Post Graduate Work Permit is always available to students who graduate in Canada and want to work to be able to work for any employer. The specific visa holders category consists of the spouses of skilled workers, spouses of students, PGWP holders, Post-doctoral Ph.D. fellows and award recipients, and students seeking off-campus employment.
How to get an LMIA to Work in Canada?
It is not possible for everyone to work without an LMIA in Canada unfortunately. Your employer needs to take the LMIA route if you don’t fall under the LMIA- exempt categories and have a job offer in Canada and want to get a work permit.
Your employer who wants to hire you must complete the steps and give either a copy of a Labour Market Impact Assessment or an offer of employment number to include in your application before you submit your application for a work permit.
To apply for an employer-specific work permit you will need:
- A valid job offer letter
- A contract that states the duration and location of the job
- The LMIA number
- A copy of the LMIA document
